ARIPO – TRADEMARKS

The relevant protocol on trade marks for ARIPO is the Banjul Protocol, which came into effect on 6 March 1997.  The States that have acceded to the Banjul Protocol are:

  1. Botswana
  2. Gambia
  3. Ghana
  4. Kenya
  5. Lesotho
  6. Liberia
  7. Malawi
  8. Mozambique
  9. Namibia
  10. Rwanda
  11. Sierra Leone
  12. Somalia
  13. Sudan
  14. Swaziland
  15. Tanzania
  16. Uganda
  17. Zambia
  18. Zimbabwe

However! Not all member states that have acceded to the Banjul Protocol have amended their national Trademarks Acts to recognize ARIPO registrations.  At present, the only countries whose national Trademarks Acts make provision for ARIPO trademark applications and in which ARIPO trademark registrations are enforceable are –

  1. Botswana
  2. Lesotho
  3. Liberia
  4. Malawi
  5. Namibia
  6. Swaziland
  7. Tanzania
  8. Uganda
  9. Zimbabwe
